TruScape provides professional landscaping and lawn care services to residential and commercial properties in Westmoreland County, Pennsylvania, including but not limited to:

  • Lawn mowing and maintenance

  • Snow removal and ice management
  • Mulching, edging, and trimming
  • Hydroseeding and lawn renovation
  • Seasonal cleanups and maintenance

Service availability, pricing, and scope are subject to change and will be confirmed in writing through quotes, contracts, or service agreements.

3. Service Agreements and Quotes

Quotes

Quotes provided through our website or in person are estimates based on the information available at the time. Final pricing may vary based on actual site conditions, scope changes, or unforeseen circumstances. All quotes are valid for 30 days unless otherwise stated.

Service Contracts

For recurring services (e.g., seasonal lawn care, snow removal contracts), a written service agreement will specify:

  • Service description and frequency
  • Contract duration and renewal terms
  • Pricing and payment terms
  • Cancellation policy

You agree to review and sign service agreements before work begins. Services will not commence until an agreement is executed.

4. Payment Terms

Payment terms will be specified in your service agreement or invoice. Generally:

  • One-Time Services: Payment is due upon completion unless otherwise agreed in writing.
  • Recurring Services: Payment may be due monthly, quarterly, or per service visit as specified in your contract.
  • Late Payments: Invoices not paid within 30 days of the due date may incur a late fee of 1.5% per month (18% annually) or the maximum rate allowed by law.
  • Payment Methods: We accept cash, checks, credit cards, and ACH transfers.

We reserve the right to suspend or terminate services for accounts with outstanding balances.

5. Cancellations and Rescheduling

One-Time Services

You may cancel or reschedule a one-time service by contacting us at least 24 hours in advance. Cancellations with less than 24 hours' notice may incur a cancellation fee.

Recurring Service Contracts

For seasonal or annual contracts:

  • Cancellation requires written notice at least 30 days before the end of the current billing period
  • Early termination may result in cancellation fees as specified in your contract
  • Snow removal contracts may not be canceled mid-season

6. Property Access and Liability

Access to Property

By engaging our services, you grant TruScape and its employees permission to access your property to perform contracted work. You agree to:

  • Provide clear access to work areas
  • Remove or secure any obstacles, pets, or hazards
  • Inform us of any underground utilities, irrigation systems, or hidden obstacles

Customer Responsibilities

You are responsible for:

  • Marking underground utilities before work begins (contact PA 811)
  • Notifying us of any property damage or concerns within 24 hours of service
  • Ensuring pets are secured during service visits
  • Maintaining adequate property insurance

Our Liability

TruScape carries general liability insurance and workers' compensation insurance. We are not liable for damage to unmarked underground utilities, pre-existing property damage, or damage caused by factors beyond our control (e.g., weather, disease, pests). Any claims for property damage must be reported in writing within 24 hours of service.

7. Weather and Service Delays

Our services are weather-dependent. We reserve the right to reschedule or delay services due to:

  • Unsafe working conditions (e.g., heavy rain, lightning, extreme heat)
  • Excessively wet or frozen ground conditions
  • Equipment or material availability issues

We will make reasonable efforts to notify you of delays and reschedule services as soon as conditions permit. Weather delays do not constitute a breach of contract.

8. Warranties and Guarantees

We stand behind the quality of our work. Specific warranties (e.g., for plant installations, hydroseeding) will be detailed in your service agreement. Generally:

  • We warrant that services will be performed in a professional and workmanlike manner
  • Plant warranties are subject to proper customer care and watering
  • We do not warranty against Acts of God, disease, pests, or customer neglect

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for damage to unmarked utilities, pre-existing conditions, or Acts of God

10. Website Use and Intellectual Property

Permitted Use

You may use our website for personal, non-commercial purposes to:

12. Dispute Resolution

We value customer satisfaction and will work to resolve any disputes amicably. If a dispute arises:

  1. Contact us within 24 hours of the issue to allow us to address your concerns
  2. If unresolved, disputes may be submitted to mediation before pursuing legal action
  3. These Terms shall be governed by the laws of the Commonwealth of Pennsylvania
  4. Any legal action must be brought in Westmoreland County, Pennsylvania courts

13. Indemnification

You agree to indemnify and hold harmless TruScape LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your breach of these Terms, your use of our services, or your violation of any laws or third-party rights.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and TruScape LLC regarding the use of our website and services, superseding any prior agreements or understandings.
